Stronger Together - Terms and Conditions
1.2 This agreement is between You (The Client) and Maeve Kavanagh (Trainer) who delivers the Stronger Together workouts.
1.3 The online classes are not intended for individuals under the age of 18. If youmare the parent or guardian and believe your child has provided us with personal information, please contact Maeve Kavanagh to request deletion.
2.0. Obligations of your Trainer
The Trainer will use her knowledge and expertise to design safe exercise programmes online. These online group classes are not personal training sessions and it is the client's responsibility to be fit and well before partaking in these classes. Clients should check with their GP if there are any
doubts into participation. The Trainer will not be held accountable for any injuries sustained in these workouts. If you have a particular injury please advise the Trainer in advance of the classes so that an alternative exercise can be included if possible. However, it is not certain that that exercise will be included. The Trainer demonstrates modifications and progressions for exercises to assist the client in choosing a level suitable to them.
2.2 Delivery of Sessions:
The sessions are delivered via Zoom and the Trainer will be obliged to provide new content on the website. If for some unforeseen circumstance, the trainer cannot provide a live class, the trainer will ensure there is a new workout uploaded for that day in place of the live session. Should the trainer be unable to attend in a live capacity the workout will therefore
still be available. The trainer will try wherever possible to always provide new material even if this cannot be live.
Membership is paid on a recurring monthly or yearly basis. The Trainer has the right to terminate your membership payment and close your account at any time.
During Easter, Christmas and Summer holidays, there may not be live classes. However, the trainer will ensure that new content is available and the client will have access to the On Demand library of classes. In some instances a guest trainer may deliver some of the live classes.
The Trainer does not take responsibility for any interference or breakdown of technology in providing the classes. Should there be an issue with the technology the trainer will try as far as possible to provide content on that day at the correct time where possible. However the Trainer cannot be held responsible for any failure on behalf of the provider Zoom or Vimeo should the technology not be operating at that time.
The Trainer cannot be held responsible for the class failing to start on time due to a connection failure on behalf of the supplier Zoom. The Trainer will attempt as far as possible to ensure every class starts at the allocated time where possible.
3.0 Obligations of the Client
3.1 Stronger Together – Safety Statement It is the responsibility of the client to ensure:
3.1.1 There is sufficient space to perform the exercises safely and move freely without obstacles or obstructions, free from furniture, equipment and other hazards.
3.1.2 We use a wide variety of equipment, this should be in a suitable condition for the activity being performed.
3.1.3 The surrounding floor space is entirely clear to remove any hazards that may increase the risk of slips, trips or falls.
3.1.4 There are no distractions throughout the duration of the session.
3.1.5 There is sufficient heating, lighting, ventilation and hydration.
3.2 Stronger Together – Liability Waiver
You should consult with your GP prior to engaging in any all fitness and exercise programme. As with all workout sessions and in particularly when partaking in an online fitness class you need to work to your own ability and listen to your body. To reduce and avoid injury, or if you feel you are not well, you will want to check with your doctor before beginning any session. By performing any fitness exercises without direct supervision, you are performing them at your own risk. This online
sessions are conducted by Maeve Kavanagh, Personal Training. Maeve Kavanagh is not responsible or liable for any injury or harm you sustain as a result of these online sessions.
You can cancel your membership at any time. Once the
membership is cancelled the client will be able to use all services on the site for the rest of that paid month or year (depending on when you join/cancel) and after that period the site will be unavailable to use. There will be no refunds issued once the month/year is paid. Note: On the yearly membership, the trainer will, on a case by case basis consult with anyone who needs to pause/cancel their membership due to extenuating circumstances.
As part of the registration process, you will be asked to select username and password. You are entirely responsible for maintaining the security and confidentiality of your account and password. You are entirely responsible for any and all activities and conduct, whether by you or anyone else, that are conducted through your account.
The client must not download or attempt to copy or forward any of the material on this site. That is strictly forbidden and against copyright issues.
4.1 The Trainer has the right to change these Terms and Conditions to be able to offer new services or as required by law. The Client will be notified of any changes.
4.2 Payment for Subscriptions must always be made in advance.
4.3 Should the Trainer need to suspend the site for any reason the client will be informed in advance and the subscription/payments will be put on hold for that period.
